Well, in reality I'd say yes...I'd have thought the regs would go that way too, otherwise its a massive loophole for anyone to drive through.

I'd agree, in reality it is. However, I bet this is grey area and the owners will try and do as much as they can and hope the EFL bottle it.

Not entirely sure but it's possible. I think Tony is trying to put money in via a different vehicle, so he can use Teamax as guarantors but I could be way off.

F. Related party, related party transactions and fair value of related party
transactions

1. A related party is a person or entity that is related to the entity that is preparing its
financial statements (the ‘reporting entity’). In considering each possible related
party relationship, attention is directed to the substance of the relationship and not
merely the legal form.

2. A person or a close member of that person’s family (i.e. those family members
who may be expected to influence, or be influenced by, that person in his dealings
with the entity, including that person’s children and spouse or domestic partner,
children of that person’s spouse or domestic partner, and dependants of that
person or that person’s spouse or domestic partner) is related to a reporting entity
if that person:
a) has control or joint control over the reporting entity;
b) has significant influence over the reporting entity; or
c) is a member of the key management personnel of the reporting entity or of a
parent of the reporting entity.

3. An entity is related to a reporting entity if any of the following conditions apply:

a) The entity and the reporting entity are members of the same group (which
means that each parent, subsidiary and fellow subsidiary is related to the
others);


b) The entity and the reporting entity are controlled, jointly controlled, or
significantly influenced by the same government;
c) One entity has significant influence over the other entity;
d) One entity is an associate or joint venture of the other entity (or an associate
or joint venture of a member of a group of which the other entity is a member);
e) Both entities are joint ventures of the same third party;
f) One entity is a joint venture of a third entity and the other entity is an associate
of the third entity;
g) The entity is controlled or jointly controlled by a person identified in
paragraph 2;
h) A person identified in paragraph 2(a) has significant influence over the entity
or is a member of the key management personnel of the entity (or of a parent
of the entity);
i) The entity, or any member of a group of which it is a part, provides key
management personnel services to the reporting entity.

4. A related party transaction is a transfer of resources, services or obligations
between related parties, regardless of whether a price has been charged
(disclosure requirements in respect of related parties and related party
transactions are set out in Annex VI).

Enforcing - not so sure. But what does come to mind is that if Dr Tony Xia had any real cash, he could just try pumping it in and take the risk, as opposed to trying to set up loans (that might be from related parties in any event).
